Please read these Terms and Conditions (“Terms”) carefully before using the https://holmeleighfarmyard.co.za website (the “Service”) or visiting Holmeleigh Farmyard (the “Farm”, “we”, “us”, “our”).

By accessing this website, making a booking through it, or visiting the Farm, you agree to be bound by these Terms. If you disagree with any part of these Terms, please do not use the Service or visit the Farm.

Interpretation and Definitions

Interpretation

Words with an initial capital letter have meanings defined under the following conditions. These definitions apply whether they appear in singular or plural.

Definitions

For the purposes of these Terms and Conditions:

  • Company (referred to as either “the Company”, “the Farm”, “We”, “Us” or “Our”) refers to Holmeleigh Farmyard, Grey Dawn Road, off Kragga Kamma Road, Port Elizabeth (Gqeberha), South Africa.
  • Country refers to South Africa.
  • Service refers to the Website.
  • Visitor or You means the individual accessing the Service, booking a Party or School Tour, or entering the Farm premises, including any children in that individual’s care.
  • Website refers to Holmeleigh Farmyard, accessible from https://holmeleighfarmyard.co.za
  • Booking means a reservation made for a Party or School Tour via the Website, telephone or in person.
  • Party means a birthday party or similar function booked at the Farm.
  • School Tour means an educational or group tour booked at the Farm.

Acknowledgment

These are the Terms and Conditions governing the use of this Service and the agreement that operates between You and the Company. These Terms set out the rights and obligations of all visitors regarding the use of the Service, and the terms applicable to visiting the Farm and making Bookings.

Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use the Service, or who visit the Farm.

By accessing or using the Service, or by entering the Farm, You agree to be bound by these Terms. If You disagree with any part of these Terms, then You may not access the Service or the Farm.

You represent that You are over the age of 18, or that You are visiting with the consent and supervision of a parent or legal guardian. Children may only enter and use the Farm’s facilities under the direct supervision of a responsible adult.

About Holmeleigh Farmyard

Holmeleigh Farmyard is a working children’s touch farm and party venue situated in Kragga Kamma, Gqeberha, South Africa, established in 1991. We offer general farm visits, a Tea Garden, kids’ birthday party packages, and school tours.

Opening Hours

We are open Friday to Sunday, 9am to 4:30pm. We are closed Monday to Thursday, as well as on Christmas Day and New Year’s Day. Opening hours may vary over school holidays and public holidays and will be communicated on the Website and our social media pages where applicable.

Entrance Fees

An entrance fee applies to visit the Farm. Entrance fees help fund the upkeep of the animals and facilities and allow us to keep our food and drink prices reasonable. Current pricing is available on request or at the gate and may change from time to time without prior notice.

Farm Visit Rules

To help keep everyone, and our animals, safe, all visitors agree to the following while on the premises:

  • Children must be supervised by a responsible adult at all times.
  • Animals must be treated gently and with respect, and only fed food or feed provided or approved by the Farm.
  • Visitors must follow any instructions given by Farm staff regarding animal handling, play equipment, or general safety.
  • Running, rough play, or unsafe behaviour around animals, the tractor, jumping castle, trampolines or other equipment is not permitted.
  • We reserve the right to refuse entry or ask a visitor to leave the premises if their conduct puts themselves, others, or the animals at risk, without refund.
  • No outside alcohol may be brought onto the premises.

Bookings — Birthday Parties

  • Deposit: A non-refundable deposit of R1,000 is required to secure a Party booking. This deposit is not refundable in the event of cancellation by You for any reason.
  • Catering: No personal food or beverages may be brought onto the premises for a Party, with the exception of the birthday cake. A range of platters and refreshments are available to order through Us.
  • Time slots: Available Party time slots are 09:30–12:30 and 14:00–16:30. You may arrive up to 30 minutes before Your time slot to set up décor. Parties must end and vacate the venue by the end of the booked time slot.
  • Pricing: Party pricing depends on the number of adults and children attending and any catering ordered, and is confirmed in Your individual quote and booking summary, which includes a 10% gratuity.
  • Final numbers and balance: Final guest numbers and any outstanding balance must be confirmed and settled by You in line with the timelines communicated at the time of booking. Charges are based on confirmed numbers even if fewer guests attend on the day.
  • Rescheduling: We understand that plans change. Requests to reschedule a Party must be made as far in advance as possible and are subject to availability. We will do our reasonable best to accommodate a new date, but rescheduling is not guaranteed, particularly for requests made close to the booked date, and the deposit remains non-refundable regardless of whether the booking is rescheduled or cancelled.
  • Weather: Holmeleigh Farmyard is an outdoor venue. Parties generally proceed rain or shine, with cover available in parts of the venue. In the case of severe weather that makes it unsafe to proceed, We will contact You to discuss rescheduling options. We are not liable for any losses You may incur (for example, third-party entertainers, decor or catering booked separately) due to weather-related changes.
  • Right to refuse or cancel a Booking: We reserve the right to decline or cancel a Booking, including where the Farm is unable to safely host the Party (for example, due to circumstances beyond our control), in which case We will offer a reasonable alternative date where possible.

Bookings — School Tours

School Tour bookings, pricing, group size requirements, and any deposit or payment terms will be confirmed directly with the school or group organiser at the time of enquiry or booking. General Farm Visit Rules and the liability and indemnity provisions in these Terms apply equally to School Tours.

Assumption of Risk, Liability and Indemnity

Please read this section carefully. It affects Your legal rights.

Holmeleigh Farmyard is a working animal farm and outdoor activity venue. Activities and features on the premises may include, but are not limited to, animal handling and feeding, a jumping castle, trampolines, tractor rides, and general outdoor play areas. Participation in these activities carries an inherent risk of injury, illness, or loss, including risks associated with animals, uneven or natural terrain, play equipment and interaction with other visitors.

By entering the Farm and/or participating in any activity, You acknowledge and accept these inherent risks on behalf of Yourself and any minor in Your care.

To the fullest extent permitted by South African law:

  • You, and any minor in Your care, enter the Farm and use its facilities, equipment and activities entirely at Your own risk.
  • Neither the Company, its owners, employees, nor agents shall be liable for any injury, illness, death, loss or damage to person or property arising from Your visit or Your use of the Farm’s facilities, animals, equipment or activities, except to the extent such loss or damage is caused by the gross negligence or wilful misconduct of the Company, its employees or agents.
  • You indemnify and hold harmless the Company, its owners, employees and agents against any claim, loss, damage, cost or expense (including legal costs) arising out of or in connection with Your visit, Your Booking, or Your (or Your minor’s) presence at or use of the Farm.
  • Nothing in these Terms is intended to exclude or limit any liability that cannot lawfully be excluded or limited under the Consumer Protection Act 68 of 2008 or other applicable South African law.

Parents and guardians are responsible for assessing whether the Farm’s activities are suitable for the children in their care, and for supervising them accordingly throughout the visit.

User-Generated Content and Photography

We may take photographs or video at the Farm from time to time, including of visitors and children, for use in our marketing material, website, and social media. By visiting the Farm, You consent to this unless You notify us in writing beforehand that You (or Your child) do not wish to be photographed, in which case We will make reasonable efforts to accommodate Your request.

Intellectual Property

The Service and its original content (excluding content provided by You or other visitors), features and functionality, including the Holmeleigh Farmyard name and logo, are and will remain the exclusive property of the Company. You may not use our name, logo or other branding without our prior written consent.

Links to Other Websites

Our Service may contain links to third-party websites that are not owned or controlled by Us. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites. We strongly advise You to read the terms and privacy policy of any third-party website You visit.

Termination

We may restrict, suspend or terminate Your access to the Service or entry to the Farm at any time, without notice, for conduct that We believe violates these Terms or is harmful to other visitors, the animals, the Company, or third parties, or for any other reason at Our discretion.

Limitation of Liability

To the extent not already addressed above and to the maximum extent permitted by applicable law, in no event shall the Company or its suppliers be liable for any special, incidental, indirect, or consequential damages arising out of or in connection with Your use of the Service or Your visit to the Farm, even if the Company has been advised of the possibility of such damages.

“AS IS” and “AS AVAILABLE” Disclaimer

The Service is provided to You “AS IS” and “AS AVAILABLE”, without warranty of any kind. The Company does not warrant that the Service will be uninterrupted, timely, secure, or error-free, or that information on the Service (including pricing, availability, and opening hours) is complete, reliable, current or accurate at all times.

Governing Law

These Terms shall be governed and construed in accordance with the laws of South Africa, without regard to its conflict of law provisions.

Disputes Resolution

If You have any concern or dispute about the Service or a Booking, You agree to first try to resolve the dispute informally by contacting Us.

Severability and Waiver

Severability

If any provision of these Terms is held to be unenforceable or invalid, such provision will be changed and interpreted to accomplish the objectives of such provision to the greatest extent possible under applicable law, and the remaining provisions will continue in full force and effect.

Waiver

Except as provided herein, the failure to exercise a right or to require performance of an obligation under these Terms shall not affect a party’s ability to exercise such right or require such performance at any time thereafter, nor shall the waiver of a breach constitute a waiver of any subsequent breach.

Changes to These Terms and Conditions

We reserve the right, at Our sole discretion, to modify or replace these Terms at any time. If a revision is material, We will make reasonable efforts to provide notice, such as posting the updated Terms on this page and updating the “Last updated” date, prior to any new terms taking effect. By continuing to access or use Our Service or visit the Farm after those revisions become effective, You agree to be bound by the revised terms.
