We encourage you to review Payfast’s privacy policy before submitting payment information through its services.
6. Direct Marketing
We may communicate with you about Holmeleigh Farmyard’s services, activities, promotions or events where we are legally entitled to do so.
Where POPIA requires us to obtain your consent before sending electronic direct marketing communications, we will obtain that consent.
You may opt out of receiving marketing communications from us at any time by using an unsubscribe facility provided in the communication, where available, or by contacting us.
Opting out of marketing communications will not prevent us from sending communications that are reasonably necessary in connection with an existing enquiry, booking, payment or transaction.
7. Cookies and Similar Technologies
Our website may use cookies and similar technologies.
Cookies are small files that may be placed on your device when you visit a website. They can be used to enable website functionality, remember preferences, maintain security and provide information about how visitors use the website.

Where applicable law requires consent before non-essential cookies or similar technologies are used, we will request the appropriate consent.
8. Sharing Personal Information
We do not sell your personal information.
We may disclose or provide access to personal information where reasonably necessary to third parties that assist us in operating our business, providing our services or maintaining our website.
These may include, where applicable:
- Payfast, for payment processing;
- website hosting providers;
- website developers and IT support providers;
- email and communications providers;
- booking and form-processing service providers;

Where another party processes personal information on our behalf as an operator under POPIA, we will take reasonable steps to ensure that appropriate safeguards are in place.
Certain third parties, including payment service providers, may also process personal information as responsible parties in their own right in accordance with their legal obligations and privacy policies.
We may also disclose personal information where required or permitted by law, including in response to a lawful request from a court, regulator, law-enforcement agency or government authority, or where disclosure is reasonably necessary to protect our rights, property, customers, visitors or the public.

Some of the technology, payment, hosting, email, cloud, analytics or other service providers used by us may process or store personal information outside South Africa.
Where personal information is transferred outside South Africa, we will take reasonable steps to ensure that the transfer complies with POPIA and applicable requirements relating to transborder flows of personal information.
Third-party service providers may have their own arrangements for international processing and transfers, as described in their respective privacy policies.
10. How Long We Keep Personal Information
We retain personal information only for as long as reasonably necessary to fulfil the purposes for which it was collected, or for as long as required or permitted by applicable law.
The appropriate retention period may depend on:
- the nature and sensitivity of the information;
- the purpose for which it was collected;
- whether a booking or financial transaction took place;
- our legal, tax and accounting obligations;
- contractual requirements;
- the need to resolve complaints or disputes; and
- the establishment, exercise or defence of legal claims.
Payment and transaction records may need to be retained for periods required by applicable financial, tax, accounting or other legislation.
When personal information is no longer reasonably required and we are not legally required or entitled to retain it, we will delete, destroy or de-identify it as appropriate.

We take reasonable and appropriate technical and organisational measures to protect personal information against accidental or unlawful loss, damage, destruction, alteration, unauthorised access, disclosure or other unlawful processing.
Our security measures may include appropriate administrative, technical and physical safeguards having regard to the nature of the personal information and the risks associated with its processing.
Payment credentials submitted directly through Payfast are protected and processed through Payfast’s payment infrastructure rather than being stored by Holmeleigh Farmyard.
However, no website, internet transmission, electronic storage system or payment system can be guaranteed to be completely secure.
If we become aware of a security compromise involving personal information for which we are responsible, we will take appropriate steps in accordance with POPIA, including notifying the Information Regulator and affected data subjects where required.

We may need to verify your identity before responding to a request involving your personal information.
Your rights may be subject to limitations or exceptions contained in POPIA or other applicable legislation.
13. Information Regulator
If you believe that we have processed your personal information in contravention of POPIA, you have the right to lodge a complaint with the Information Regulator of South Africa.
The Information Regulator is the independent authority responsible for monitoring and enforcing compliance with POPIA.
Current contact details and complaint procedures are available on the Information Regulator’s official website.
14. Third-Party Websites and Services
Our website may contain links to, or integrate with, websites, payment services, social-media platforms or other services operated by third parties.
